TERMS AND CONDITIONS
These general terms and conditions of sale apply to all orders placed on the website www.jahika.com by natural or legal persons acting as consumers or non-professionals.
These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with www.jahika.com operated by JAHIKA (“us”, “we”, or “our”).
Your access to, and use of our website www.jahika.com is conditioned on your acceptance of, and compliance with these terms. These terms apply to all visitors, users and others who access or use our website www.jahika.com.
The www.jahika.com website is published by the company JAHIKA SASU (single-member simplified joint-stock company), registered with the RCS of Nice under number 948 778 436, whose registered office is located at 10 bis Rue Henry de Bournazel, 06300 Nice - France. The intra-community VAT number is FR09948778436.
The seller can be contacted by e-mail at the address contact@jahika.com or by mail at the address of the registered office.
The customer declares to have read and accepted these Terms and Conditions before placing his order. The validation of the order therefore implies acceptance of the terms and conditions.
Article 1: Introduction
JAHIKA is a company having its registered office at 10 bis Rue Henry de Bournazel, 06300 Nice - France.
It is registered in the commercial register under number RCS 948 778 436

Article 2: Purpose
These terms and conditions of the website www.jahika.com exclusively govern the contractual relations between the customer and the seller
All purchases must be made by an adult or minor with parental consent.
Article 3: Acceptance of the terms and conditions and Validation of orders
Any order implies the reading and full acceptance of the general conditions of sale of the site www.jahika.com.
Article 4: Presentation of products
The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred in this presentation, JAHIKA cannot be held liable.
The essential characteristics of the products are described and presented as accurately as possible. The photographs are not contractual and may differ from the delivered products.
Article 5: Price
The prices of the products are indicated in euros all taxes included (TTC) excluding participation (see paragraph Deliveries). They take into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the prices of the products.
The price is payable in full and in a single instalment. The seller reserves the right to modify its prices at any time, but undertakes to apply the rates in force at the time of the order, under reserve of availabilities of products at the time of the order.
Article 6: Orders and Secure Payment
Any order implies express and irrevocable acceptance of the prices and descriptions of the products available for sale. The user declares to have read and irrevocably accepted these general conditions of sale before placing his order. From the last click of acceptance, the order is considered irrevocable.
The seller reserves the right not to confirm an order in case of out of stock, unavailability of the product, problem with the order received (for example: incorrect address), or dispute with the customer. In this case, the seller informs the customer by e-mail and proceeds to the refund of any sums paid within a maximum period of 14 days.
The seller retains ownership of the products until full payment of the price by the customer. The transfer of risk takes place upon delivery of the products to the address indicated by the customer.
Paragraph 6.1: Secure Payment by credit card
You can pay by credit card. No banking information about you passes through the seller's site. Payment by credit card is therefore perfectly secure. Your order will be registered as soon as payment is accepted by the banking service. You can pay online with confidence by entering the number, expiration date and security code on the back of your credit card in the slots provided.
Your credit card details are encrypted using SSL. Payment is made directly to the bank. The seller has no access to these details, and does not keep them on its servers.
The seller reserves the right to suspend or cancel any order in the event of a payment incident, fraud or attempted fraud.
The seller reserves the right to check the validity of the payment, before the shipment of the order, by any means that the seller deems necessary. Our services may ask you for all kinds of supporting documents to unlock your order: ID, proof of address...

Article 7: Delivery
The products are delivered to the address indicated by the customer when ordering. The customer is responsible for the accuracy and completeness of the information provided.
The seller does not cover the customs fees. These customs duties and possible taxes related to the delivery of an item are the responsibility of the customer and are your responsibility.
We are not obliged to inform you of applicable customs duties and taxes. We want our customers to be aware that cross-border deliveries may be subject to an opening and inspection procedure by customs authorities.
JAHIKA makes deliveries from Monday to Friday (working days).
The deadlines are given as an indication and do not constitute a contractual commitment of the seller. In case of delay or error in delivery, the customer can contact the seller's customer service by e-mail to the address contact@jahika.com or by mail to the address of the registered office.
The customer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs. To exercise this right, the customer must inform the seller of his decision by e-mail or post and return the products in their original packaging, accompanied by the delivery note and a copy of the invoice, to the following address: 10 bis Rue Henry de Bournazel, 06300 Nice - France.
The seller undertakes to reimburse the customer within a maximum period of 14 days from receipt of the returned products. The refund is made by the same means of payment as that used by the customer when ordering.
The amount of the delivery is calculated automatically at the best rate according to the address of the recipient.
Article 8: Return and Refund
In accordance with Articles L.120-20, the consumer has a period of fourteen (14) calendar days to return, the products not suitable for him.
For any return and refund, you must make your request via our contact section. The return for a refund is at your expense.
Only new, clean, complete products with their labels still attached and in perfect condition for resale will be taken back or exchanged.
Items should be tried on with your underwear, with the hygienic protective self-adhesive strips still in place. All items that do not comply with this procedure cannot be returned.
Any product that has been damaged, will not be refunded or returned.
After checking the goods, we will proceed as soon as possible to the refund.
The refund is made to the credit card with which you placed the order.
Article 9: Modification of the General Terms and Conditions of Sale
The seller reserves the right to adapt or modify these general conditions of sale at any time.
Article 10: Product guarantees
The products sold on the website benefit from the following legal guarantees:
- The legal guarantee of conformity which allows the customer to obtain the repair or replacement of a non-compliant or defective product for 2 years from the delivery of the product (articles L.217-4 and following of the Consumer Code)
- The legal guarantee against hidden defects which allows the customer to obtain the refund or reduction of the price of a product affected by a hidden defect which makes it unfit for the use for which it is intended or which so diminishes this use that the customer would not have bought it or would not have paid the same price if he had known it for 2 years from the discovery of the defect (articles 1641 and following of the code civilian)
To benefit from these guarantees, the customer must contact the seller's after-sales service by e-mail to the address contact@jahika.com or by mail to the address of the head office and return the defective or non-compliant product at his expense.
The seller undertakes to repair or replace the product as soon as possible and at no cost to the customer. If repair or replacement is not possible or entails disproportionate costs for the seller, the seller may offer the customer a price reduction or a refund.
The warranties do not cover defects resulting from abnormal or improper use of the product, normal wear and tear, accident or an external cause (e.g. exposure to the sun, contact with salt or chlorinated water, etc.).

Article 12: Personal data
The seller collects and processes customers' personal data in compliance with the Data Protection Act of 6 January 1978 as amended and the General Data Protection Regulation (GDPR) of 27 April 2016.
The personal data collected are as follows:
- Surname, first name, e-mail address, password
- Postal address, telephone number
- Credit card number
This data is necessary to ensure the management of orders, deliveries, invoices and after-sales services. They are kept for the time necessary for these purposes.
The seller may also use this data to send the customer promotional offers or information about its products and services, subject to the prior and express consent of the customer. The customer can unsubscribe at any time by clicking on the link provided for this purpose in the emails received or by contacting the seller.
The seller does not disclose the personal data of customers to third parties, unless this is necessary for the execution of the contract (e.g. carrier, payment provider) or if this is required by law or a competent authority.
The customer may also lodge a complaint with the Commission nationale de l'informatique et des libertés (CNIL) if he considers that the processing of his data does not comply with the regulations in force.
Article 13: Intellectual property
All elements of the jahika.com site are protected by copyright, trademark law and design law. Any reproduction, imitation or total or partial exploitation of these elements without the express authorization of the seller is prohibited and constitutes an infringement punishable by the code of intellectual property.
Article 14: Applicable law and competent jurisdiction
These terms and conditions are subject to French law. In the event of a dispute relating to their interpretation or execution, the French courts have sole jurisdiction.
